CatzCode is committed to protecting the privacy and security of users of our NursingStats app, visitors to our websites, personnel of healthcare organizations, job applicants, and visitors to our premises (together, “you”). This Privacy Notice describes how we process your Personal Information in contexts outside the NursingStats app, which does not collect Personal Information, and how you can exercise your privacy rights. This notice is issued by the Controller entities listed in Section 16 (together, “CatzCode”, “we”, “us”, “our”). Capitalized terms are defined in Annex A – Definitions. About Us

CatzCode develops innovative software for the healthcare sector, specializing in nursing statistics. Our flagship NursingStats app is a staffing calculator that performs calculations locally on your device to provide insights into patient care metrics, staffing levels, and clinical outcomes without collecting Personal Information. We do not create user accounts or maintain databases of user data for the app. Our services, including the app and website (catzcode.com), do not use proprietary analytics or targeted advertising.

Our Handling of Nursing Statistics

The NursingStats app does not collect or store Personal Information, including names, addresses, phone numbers, passwords, or Protected Health Information (PHI). All data you enter (e.g., counts, census, shift info) is processed and stored locally on your device or in files you export. You can manage or delete this data via the app’s “Clear Data” feature or your device’s storage management. Data persists on your device until you delete it or uninstall the app, ensuring convenience for future use. No data is transmitted to us.

Important Disclaimers

The app is a convenience tool for basic staffing calculations and does not constitute clinical, nursing, medical, administrative, or legal advice, including with respect to CMS regulations (e.g., 42 CFR Part 483 for staffing standards). Users must independently verify outputs to ensure compliance with CMS, facility policies, and applicable laws. CatzCode disclaims liability for regulatory non-compliance (see Terms of Use). For non-app interactions (e.g., support emails, recruitment), we comply with applicable privacy laws, including GDPR, UK GDPR, and HIPAA. We are not a HIPAA-covered entity but may act as a business associate for limited non-app interactions (e.g., support emails containing PHI), subject to Business Associate Agreements where required. 2. Personal Information We Process

The NursingStats app does not collect Personal Information. In other contexts (e.g., website interactions, support emails, job applications), we may process limited Personal Information depending on your interactions, location, and applicable law. Categories include:

2.1 Information You Provide to Us

• Personal Details: Name, preferred name, job title (e.g., nurse, administrator).

• Contact Details: Email address, mailing address, telephone number, message content (e.g., support emails to info@catzcode.com).

• Correspondence: Records of communications with us.

• Website Data: Troubleshooting/support data, contact form submissions.

• Security Information: Encrypted passwords (e.g., job application portals), login attempt details, security settings.

• Views and Opinions: Feedback sent to us or posted publicly about us on social media.

• Public Information: Data you share publicly (e.g., social media posts about us).

• Content Information: Data from third-party content (e.g., cookies) on our website.

• Consent Records: Records of consents, including date, time, and subject matter.

• Employer Details: Employer name, address, phone, email, if relevant.

• Demographic Information: Gender, date of birth/age, nationality (job applicants only), language preferences.

2.2 Information from Nursing Students

The app does not collect Personal Information from students or users. If institutions use our services for educational purposes, we process limited anonymized metrics (not linked to Personal Information) as a processor at the institution’s direction.

2.3 Information from Candidates

• Provided Information: Name, email, address, phone, date of birth, qualifications, employment history, skills, video (if using Video Interview feature).

• Recruitment Record: Progress through our hiring process.

2.4 Information We Collect Automatically as Service Usage Data

In some countries (e.g., UK, EEA), these may be considered Personal Information:

• Technical Data: Browser/device information (e.g., MAC address, screen resolution, OS version, device model, browser type).

• Usage Data: Website access dates/times, browsing activities, performance metrics.

• Log Data: Server logs recording IP addresses, website activity, metadata from uploaded files.

• Cookie Data: Cookies collecting browser type and anonymous traffic data (see our Cookie Notice at catzcode.com/cookie-notice).

The app does not use proprietary analytics to track in-app behavior.

The app does not collect Personal Information. For other interactions, we use Personal Information for:

• Abuse Prevention: Protecting against website misuse, ensuring compliance (legal bases: legitimate interest, legal obligations).

• Legal Compliance: “Know Your Customer” checks, sanctions screenings (legal bases: legal obligations, legitimate interest, consent).

• Legal Claims: Managing or defending claims (legal bases: legal obligations, legitimate interest, necessary for claims).

• Recruitment: Processing applications, candidate communication (legal bases: employment law, legitimate interest, consent).

The NursingStats app may display ads via third-party ad networks (e.g., Google AdMob), which may process limited device/usage data (e.g., advertising identifiers, device type, IP address) for ad delivery, subject to their privacy policies (see Google AdMob’s policy at admob.google.com/home/privacy). You can limit ad tracking or opt out of personalized ads via device settings (e.g., iOS Advertising Identifier, Android Advertising ID). The app does not integrate with third-party applications collecting Personal Information. Our website may include social media features (e.g., Twitter, LinkedIn), governed by their privacy policies. Links to third-party websites are provided for convenience, but their practices may differ. Review their policies before interacting.

5. Your Data Protection Rights

Depending on your jurisdiction, you may have:

• Right to Refuse: Choosing not to provide Personal Information (may limit website functionality).

• Access: Request access to or copies of your Personal Information.

• Rectification: Correct inaccuracies.

6. Sharing Your Personal Information

The app does not collect or share Personal Information. In other contexts, we share it only with:

• Affiliates: For business purposes (e.g., internal operations).

• Service Providers: For web hosting, analytics, under strict data protection agreements.

• Recruitment Partners: With consent, per their privacy notices.

• Social Media Partners: For promotions (excluding Children’s data).

The NursingStats app stores data locally; you can clear it via the app’s “Clear Data” feature or device settings. Secure your device with a passcode, biometrics, and updated OS. For non-app contexts, we maintain:

• Encryption of data in transit and at rest.

• HIPAA/GDPR-compliant firewalls and access controls.

• Limited access to authorized personnel.

• Breach response procedures with notifications as required.

8. International Transfers

The app does not collect Personal Information, so no transfers occur. For non-app data (e.g., support emails), we may transfer data to countries where we or our service providers operate, using:

• Standard Contractual Clauses (SCCs) approved by the European Commission/UK ICO.

9. Retention of Personal Information

The app does not retain Personal Information. Locally stored data (e.g., staffing metrics) persists until you delete it via app settings or device management. For non-app contexts, we retain data only as long as necessary for:

3. Legal claims.

10. California, Colorado, Connecticut, Utah, and Virginia Consumers

The app does not collect Personal Information. For non-app interactions, we process limited data (e.g., support emails, website usage) as in Section 2, sharing with affiliates, service providers, or others with consent. We do not sell or share data for cross-context behavioral advertising. You may request:

1. Access to Personal Information (categories, sources, purposes, third parties).

2. Correction of inaccuracies.

3. Deletion of data.

4. Portability in a portable format.

11. Do Not Track

We do not follow “Do Not Track” browser requests, adhering to this notice. The app does not use proprietary analytics; third-party ad networks may process limited device data, controllable via device settings.

12. Changes to This Notice

We may update this notice. Material changes will be notified via email or website. The “Effective” date reflects the latest version. Continued use signifies acceptance.

13. Our Collection of Personal Information from Children

The app is not directed to children under 13 (US) or 16 (outside US) and does not collect their data. In other contexts, we do not knowingly collect Children’s data. Parents can contact info@catzcode.com to request review or deletion.

14. Questions & Concerns

15. Automated Decision Making or Profiling

Recruitment partners may use automated tools for candidate selection, but final decisions are human-made. You may object to automated decisions with legal effects.

16. Controllers

The Controller is: CatzCode, info@catzcode.com. For UK/EEA services, we act as a processor under GDPR/UK GDPR, with the organization (e.g., healthcare facility) as the controller.

17. Direct Marketing

With consent, we may email you about services. Unsubscribe via email links or info@catzcode.com. The app does not involve marketing; ad networks may display ads, controllable via device settings.

18. Annex A – Definitions

• Affiliate: Entity with 50%+ ownership/control by/with CatzCode.

• App: NursingStats and other CatzCode applications.

• Child/Children: Under 13 (US) or 16 (outside US).

• Control: 50%+ ownership/voting interest.

• Cookie: Small file on your device from websites (see catzcode.com/cookie-notice).

• EEA: European Economic Area.

• EU: European Union.

• CatzCode: CatzCode and affiliates.

• Partner: Third-party job sites for CatzCode applications.

• Personal Information: Data identifying an individual (e.g., name, email).

• Privacy Notice: This notice.

• Profiling: Automated processing to evaluate personal aspects.

• Services: CatzCode’s platform, including the app.

• Service Usage Data: Automatically collected website data (Section 2.4).

• T&C: Terms of Use.

NursingStats — Terms of Use

1. Acceptance of Terms

By downloading, accessing, or using NursingStats (“App”), you agree to these Terms of Use. If you do not agree, do not use the App.

2. License to Use

We grant you a personal, limited, non-exclusive, non-transferable license to use the App for lawful purposes. You may not reverse-engineer, modify, resell, or use the App in violation of laws or third-party rights.

3. Professional Disclaimer

The App provides calculations and summaries for convenience only. It does not constitute clinical, nursing, medical, administrative, or legal advice, including with respect to CMS regulations on minimum staffing standards for long-term care facilities (e.g., 42 CFR Part 483). You are solely responsible for ensuring compliance with CMS regulations, facility policies, accreditation standards, and applicable laws, including minimum staffing hours per resident day (HPRD), facility assessments, or 24/7 RN requirements. Check for CMS updates at cms.gov to ensure compliance. You must verify, validate, and check all App outputs before relying on them to avoid non-compliance, resident harm, or operational errors. CatzCode disclaims all liability for regulatory non-compliance.

4. User Responsibilities

• Do not input Protected Health Information (PHI) unless permitted by law and your device is secured (e.g., encryption, passcode, biometrics).

• Validate all outputs before operational use, ensuring CMS compliance.

• Manage locally stored data (e.g., staffing metrics) via the App’s “Clear Data” feature or device settings. Data persists until deleted or the App is uninstalled.

• Use the App in compliance with all applicable regulations.

5. Third-Party Services

The App may integrate third-party services (e.g., Google AdMob), which may process limited device data (e.g., advertising identifiers, device type, IP address) for ad delivery, per their privacy policies (see admob.google.com/home/privacy). We are not responsible for third-party content or practices. Control ad-related data via device settings.

6. Intellectual Property

“NursingStats,” related names, logos, and content are protected by intellectual property laws. No rights are granted beyond the license above. Do not use our marks without permission.

7. No Warranties

The App is provided “as is” and “as available,” without warranties of accuracy, fitness for purpose, or non-infringement. Use is at your sole risk, including for CMS compliance.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or loss of data, profits, revenue, or business arising from App use, including CMS-related claims.

9. Indemnification

You agree to indemnify and hold us harmless from claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising from App use or violation of these Terms, including non-compliance with CMS regulations.

10. Termination

We may suspend or terminate App access if you violate these Terms or as required by law.

11. Governing Law

These Terms are governed by U.S. law and your state/country of residence, without regard to conflict-of-laws principles. Courts in that jurisdiction have exclusive authority over disputes.

12. Changes to the Terms

We may modify these Terms, effective when posted or made available. Continued use signifies acceptance.
